Terms of Service

These Terms govern your use of the Actuo mobile app (“Actuo”, the “app”), published by Ottermill. By downloading or using the app you agree to these Terms. If you do not agree, do not use the app.

1. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use Actuo for your own exam preparation, subject to these Terms and the app store’s terms.

2. Not affiliated; not professional advice

Actuo is an independent study-planning tool. It is not affiliated with, endorsed by, or sponsored by the Society of Actuaries (SOA) or any other exam administrator. Exam names such as “Exam P”, “Exam FM”, and “Exam FAM” are used only to identify the exams the app helps you plan for. Study plans, topic weightings, and suggestions are general guidance and may not reflect the current official syllabus. We do not guarantee any exam result. You are responsible for verifying the current syllabus with the official source.

3. Subscriptions & billing

• Actuo Premium is an auto-renewable subscription offered on a monthly or yearly basis at the price shown in the app.
• Payment is charged to your Apple ID or Google account at confirmation of purchase.
• The subscription renews automatically unless canceled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
• Manage or cancel anytime in your App Store or Google Play account settings. Deleting the app does not cancel a subscription.
• If a free trial is offered, any unused portion is forfeited when you purchase a subscription, where applicable.
• Refunds are handled by Apple or Google under their policies; we generally cannot issue refunds directly.

4. Acceptable use

You agree not to reverse engineer, resell, or misuse the app, or use it in violation of applicable law.

5. Intellectual property

The app, its design, and its content (excluding third-party exam names used nominatively) are owned by Ottermill and protected by law.

6. Disclaimers

The app is provided “as is” and “as available”, without warranties of any kind, to the fullest extent permitted by law, including any warranty that it will help you pass any exam.

7. Limitation of liability

To the fullest extent permitted by law, Ottermill will not be liable for indirect, incidental, or consequential damages, or for any exam outcome, arising from your use of the app. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

8. Termination

We may suspend or terminate access if you breach these Terms. You may stop using the app at any time by deleting it.

9. Governing law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-laws rules.

10. Changes

We may update these Terms; continued use after changes take effect constitutes acceptance. Material changes will be reflected by a new effective date.
